It is customary for a landlord to obtain and pay the costs of the tenancy agreement because it is in their best interests to determine the terms and conditions of the tenancy. Having a clear written tenancy agreement can prevent disputes from arising. If a dispute does arise, it can also save the parties time and money. A landlord can create a written tenancy agreement from scratch or even by using templates that can be obtained online.
However, this is not recommended because the tenancy agreement could be legally invalid. If this were to happen, the landlord may find themselves spending more money and time resolving a dispute with their tenant or, in serious cases, evicting them. It is therefore recommended that a written tenancy agreement is obtained from an experienced solicitor.
In the case of a straightforward assured shorthold residential tenancy, most solicitors will charge a fixed fee of no more than £100. If you find they are charging a lot more than this, it is recommended you shop around because it is highly likely you will find a solicitor who will prepare a tenancy agreement for you at this price.
Commercial leases, on the other hand, can cost thousands of pounds depending on whether the lease needs to be negotiated with the other party and the complexity of the agreement itself.
